This Privacy Policy describes how Unbroken Back LLC (“Company,” “we,” “us,” or “our”) collects, uses, and discloses information when you visit our website, opt in to our content, or otherwise interact with us online (collectively, the “Site”).

This Privacy Policy applies to our website and marketing funnel. It does not cover the separate agreement you sign if you enroll as a client, which contains its own terms regarding the information collected as part of that program.

By using the Site, you agree to the collection and use of information in accordance with this Privacy Policy.

## 1. Who We Are

Unbroken Back LLC is a California-based company. If you have questions about this Privacy Policy, you can reach us at:

– Name
– Email address
– Phone number
– Any information you voluntarily provide in forms, surveys, applications, or intake questionnaires prior to a consultation call

**Health-related information.** Because our content and consultation process relate to back pain and physical performance, forms or intake materials you complete before a call may ask about your physical condition, symptoms, or history. We collect this information only to the extent you choose to provide it, and only to help us understand whether our program may be a fit for you. We are not a medical provider, and this information is not part of a medical record. See Section 9 below.

### b) Information Collected Automatically

When you visit the Site, we and our service providers may automatically collect:

– IP address
– Browser type and version
– Device information
– Pages visited and time spent on those pages
– Referring website
– General location (city/region level, derived from IP address)

### c) Cookies and Tracking Technologies

We use cookies and similar tracking technologies to operate the Site, remember preferences, and understand how visitors use our content.

### d) Advertising Pixels

We use advertising pixels, including the **Meta (Facebook) Pixel** and **Google Ads tracking**, on our landing pages. These tools allow us to:

– Measure the effectiveness of our advertising
– Build custom or lookalike audiences for future advertising
– Retarget visitors with relevant ads on Facebook, Instagram, Google, and related platforms

These third parties may use cookies and similar technologies to collect information about your visits to this and other websites. You can learn more about how Meta and Google use this data through their respective privacy policies, and you can manage ad preferences directly through those platforms’ ad settings.

## 3. How We Use Your Information

We use the information we collect to:

– Provide the content, videos, and materials you request
– Communicate with you, including by email, text, or phone, about our program, offers, or updates
– Schedule and manage consultation calls
– Evaluate, in a general sense, whether our program may be relevant to your situation, based on information you choose to share
– Improve our website, content, and marketing
– Run and measure advertising campaigns
– Comply with legal obligations

We do not sell your personal information to third parties.

## 4. How We Share Your Information

We may share your information with:

– **Service providers** who perform functions on our behalf, including:
– **Keap** — our email marketing and customer relationship management (CRM) platform
– **Calendly** — our scheduling tool for consultation calls
– Payment processors, if and when applicable
– **Advertising platforms** (Meta, Google) for the pixel/retargeting purposes described above
– **Legal authorities**, if required by law, subpoena, or valid legal process, or to protect our legal rights
– **A successor entity**, if we are involved in a merger, acquisition, or sale of business assets

We require our service providers to handle your information consistently with this Privacy Policy and only for the purposes for which we share it.

## 5. Your Choices

– **Email communications:** You may unsubscribe from marketing emails at any time using the unsubscribe link included in every email, or by contacting us directly.
– **Cookies:** Most browsers allow you to block or delete cookies. Doing so may affect how parts of the Site function.
– **Ad personalization:** You can manage how Meta and Google use your data for advertising through their respective account settings.

## 6. Your Privacy Rights (U.S. State Residents)

Depending on your state of residence, you may have certain rights regarding your personal information, which can generally include the right to:

– Know what personal information we collect, use, and disclose
– Request deletion of your personal information, subject to certain exceptions
– Correct inaccurate personal information
– Opt out of the “sale” or “sharing” of personal information, where applicable
– Appeal a denial of a rights request, in states that provide for this
– Non-discrimination for exercising your privacy rights

To exercise any of these rights, contact us at **support@unbrokenback.com**. We may need to verify your identity before completing certain requests, and certain rights may not be available or may differ depending on your state of residence.

### California Residents (CCPA/CPRA)

If you are a California resident, the rights above are provided to you under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). We do not sell personal information for money, but our use of advertising pixels (see Section 2(d)) may be considered “sharing” for cross-context behavioral advertising purposes under California law.

**Do Not Sell or Share My Personal Information:** You may opt out of this sharing by adjusting your ad preferences directly through Meta and Google’s platforms, or by contacting us, and we will disable pixel tracking associated with your visits where technically feasible.

### Residents of Other States

Several other states — including Virginia, Colorado, Connecticut, Utah, and others — have enacted their own consumer privacy laws that provide similar rights to those described above. If you reside in one of these states, you may exercise your applicable rights using the contact information in this section. As we expand into additional states, we will update this Policy to reflect any state-specific requirements that apply.

## 7. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, and enforce our agreements.

## 8. Data Security

We use reasonable administrative and technical measures to protect your personal information. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

## 9. Not Medical Advice / Not a Medical Record

Any health-related information you provide through intake forms, applications, or consultation calls is used solely to help us understand your situation for coaching and educational purposes. We are not a medical provider, this is not a HIPAA-covered medical record, and nothing collected or discussed constitutes the creation of a doctor-patient relationship. See our Terms of Use for additional disclaimers regarding the educational nature of our content.

## 10. Children’s Privacy

Our Site is not directed to individuals under the age of 18, and we do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child without appropriate consent, we will take steps to delete it.

## 11. Third-Party Links

Our Site may contain links to third-party websites. We are not responsible for the privacy practices or content of those sites. We encourage you to review the privacy policies of any third-party site you visit.

## 12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated version on this page and update the “Last Updated” date above. Material changes will be communicated where required by law.
